Until. now, only the smallest beginnings have been made towards reconstructing the story of the development of American law. Although our legal traditions are as much a part of American culture as our political traditions, an awareness of this heritage has been largely lacking.
In this volume Professor Haskins undertakes the difficult but engrossing task of tracing the beginnings of American law in Massachusetts in the Colonial period. First, he outlines the religious, political and social forces which molded the institutions and instruments of government. Second, he develops the state of the law, public and private, in that period. This he emphasizes both the role of English tradition social, political, legal, religious, and intellectual and the role of design the conscious effort to evolve a system of laws consonant with the purposes of colonization.
In explaining the growth of the law, this book is less a detailed legislative and judicial history of early Massachusetts Bay than a germinal study which vividly describes the interrelation of law and society. It is a fascinating exposition of the alchemy of survival and adaptation of patterns of thought and habits of life in the process of developing an indigenous law responsive to the conditions of a new American civilization. This original and authoritative book is a notable contribution to the history of American law and culture.
