Summary
Karl Renner's work on the institutions of private law and their social function is an attempt to utilise the Marxist system of sociology for the construction of a theory of law. This book is concerned with the sociology of law and more particularly with the impact of economic forces and social changes upon the functioning of legal institutions.
The legal institutions which are examined are those belonging to the sphere of “Private Law”: ownership in land and movable property, contracts of various types, mortgage and lease, marriage and succession. Public Law which includes the organisation of the state and of local government bodies is outside the purview of this analysis.
As A statement and formulation of an important aspect of Marxist doctrine and as a highly original contribution to jurisprudence, this work has for many years been well known on the Continent. It is now for the first time made accessible to the English-speaking world.
