You may file a Trademark Infringement report if you find the existence of any product offering content (whether the product in its entirety or the product name) of a seller through Tokopedia's site/application that infringes your trademark, including:
  1. Product is suspected of being counterfeit or imitation
  2. Unauthorized use of registered trademark on the product name
  3. Unauthorized use of registered trademark on the product image
  4. Unauthorized use of registered trademark on the product description

You may file a Copyright Infringement report if you find the existence of any product offering content that uses Your work without authorization, including:
  1. Pirated copyright product
  2. Copyright infringement on product image(s)
  3. Unauthorized use of copyrighted work on the product

How can you report IP infrigements?

Consent And Release

The filing of report for the removal of a product offering content is a serious action, which may involve legal proceedings thereafter. By filing a report through our online form, You grant consent to Tokopedia to keep Your report and to provide Your information in the form of Name, Company, Title, Email Address and Telephone Number to the party being reported by You. You hereby represent to release Tokopedia, its employees including all its affiliates and to be fully liable for any legal consequence that may arise thereafter as a result of this action including but not limited to lawsuits from third parties arising out of Your fault or negligence in filing the report.

Trademark Infringement
For this type of reporting, you are required to enclose:
  • The Trademark Certificate registered and valid in the territory of the Republic of Indonesia.
  • The identity of the Reporting Party/party filing the report, such as: ID card or statement letter of employment.
  • Power of Attorney or Letter of Authorization if you are a representative of the owner.
Copyright Infringement
For this type of reporting, you are required to enclose evidence that the reported product offering content infringes your Copyright, namely:
  • Copyright certificate or the signed copyright claim statement.
  • Evidence of ownership of works (statement letter, power of attorney, evidence of assignment, etc.).
  • Book publishing agreement.
  • The identity of the Reporting Party/party filing the report, such as: ID card or statement letter of employment.
  • Power of Attorney or Letter of Authorization if you are a representative of the owner.
  • Other supporting evidence.

What are things that need to be considered in filling out the report form?

To avoid any technical issues, we recommend you to access the online report form using the latest Google Chrome or Mozilla Firefox browser.

If the you are an attorney or authorized party, you must enclose the letter of authorization/power of attorney or other signed statement letter that essentially explains that the you are authorized to file a report on behalf of the IP owner.

All fields available in the report form must be filled in.

The “Product Name” field may only be filled in with 1 (one) trademark/brand name pursuant to the type of report and evidences possessed. For example: the trademark name which corresponds to the name stated in the trademark certificate, etc.

The “Product Link” field must be filled in with a link that specifically directs to the reported product offering content page. We will reject Your report if:

  1. The link reported is not a specific link, but a link to stores.
  2. The link reported is another link, such as a link that directs to a site other than Tokopedia’s site, and more. For the convenience of the reporting, You may copy the link available in the “address bar” field on Your browser for each product offering content.

In the “Product Link” column, several things need to be considered in order for Your reporting to be effective:

  1. You can attach more than one product link in each report (a maximum of 5,000 product links in each report).
  2. Avoid attaching duplicate product links.
  3. If the product you want to report has many variants, you do not need to attach all product links from that variant, just attach one of these variants, because other product variants will be automatically taken down.
Please only submit a report related to Intellectual Property infringement. We strictly prohibit any other reports related to distribution or pricing issues. Tokopedia reserves the right to reinstate the listings and limit/restrict your access to the service of the IP Protection dashboard due to abusive reports.

What do you need to know after the report is submitted?

Report will be evaluated and reporter will receive Email

After the report has been successfully submitted, the reporter will receive a reporting confirmation email at the email address you entered on the reporting form. Tokopedia will check the reporting form and the attached supporting documents no later than 14 (fourteen) days after the report is received.

If your report is approved, you will receive a confirmation email of the deletion of content at the email address you entered on the reporting form.

If your report is rejected, you will receive a rejection email containing the reasons of the report rejection. You can report again via the reporting form if you can make corrections according to the information contained in the email regarding the reasons for the report rejection.

If the report is approved, product will be deleted and similar products could not be sold

After the report is approved by the Tokopedia team, the reported product will be deleted within a maximum period of 14 days from the time the report is received. Other than that, shop may not be able to sell the similar products to the previously reported one.

You have the potential to receive appeal from the reported party

You could potentially receive an appeal from a seller whose product was reported and deleted via email and/or the phone number you attached earlier when filling out the online form. You are expected to respond well to the seller's appeal. If you do not respond to the seller's appeal, you can be deemed to have accepted the seller's appeal and the product content that you reported can be reactivated.

Shops whose their products have been reported, are potentially suspended

Tokopedia has a penalty system for Sellers who repeatedly violates IP, if you find a Seller who re-uploads a product that violates your rights, we urge you to return to periodic reporting through the provided reporting form.
